Terms of Use

In plain words: Dusk is yours to use on your own Macs, for as long as you like. Please don't resell it, pull it apart or pass it off as your own. It is offered as-is, and we cannot be responsible for what happens on your computer.
1. Agreement
These Terms of Use ("Terms") are an agreement between you and Dinesh Kumar ("we", "us"), the developer of Dusk for macOS ("the app"). By downloading, installing or using the app you accept these Terms. If you do not accept them, do not install or use the app.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on Mac computers that you own or control, for personal or internal business purposes. This licence is granted, not sold. We retain ownership of the app itself.
If you obtained the app through the Mac App Store, your use is additionally governed by Apple's Licensed Application End User Licence Agreement, and where these Terms conflict with it, Apple's terms prevail.
3. What you may not do
- Sell, rent, lease, sublicense or redistribute the app, or charge others for access to it.
- Reverse-engineer, decompile or disassemble the app, or attempt to derive its source code, except to the extent that applicable law expressly permits this despite the restriction.
- Remove or alter any copyright, trademark or other proprietary notices.
- Present the app or its artwork as your own work, or use our name or marks to promote another product.
- Use the app for any unlawful purpose, or in a way that interferes with anyone else's use of their computer.
4. Ownership
The app, its source code, its visual designs, its shader artwork, its name and its icon remain our property and are protected by copyright and other intellectual property laws. Wallpaper images that the app renders on your Mac for your own personal use are yours to use personally; the underlying artwork and code remain ours, and you may not redistribute the rendered artwork commercially.
5. Updates
We may release updates that add, change or remove features. Updates are provided under these Terms unless accompanied by their own. We are not obliged to release updates, to keep any particular feature, or to support older versions of macOS indefinitely.
6. Third-party platforms
The app runs on macOS and may interact with system features such as the desktop picture, the Lock Screen and Login Items. Those features belong to Apple and may change or stop working with a future version of macOS, outside our control. Apple is not a party to these Terms and has no obligation to provide support for the app.
7. No warranty
The app is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, compatible with your particular hardware or macOS version, or that any defect will be corrected.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you, and you may have rights that these Terms cannot limit.
8. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, revenue, goodwill or business, arising out of or in connection with the app, however caused and on any theory of liability.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the app or these Terms will not exceed the greater of the amount you actually paid for the app or US $50.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
9. Your responsibility
You are responsible for maintaining backups of your computer and its data. The app changes visual settings on your Mac, including, when you enable the relevant options, the system desktop picture and, in the version downloaded directly from this website, a macOS wallpaper video file (a backup of which the app keeps so the original can be restored). Please make sure you are comfortable with that before enabling those features.
10. Termination
This licence continues until terminated. It ends automatically if you breach these Terms, and you may end it at any time by uninstalling the app and deleting all copies. Sections 4, 7, 8, 10 and 12 survive termination.
11. Changes to these Terms
We may revise these Terms from time to time. The revised version will be posted on this page with a new "last updated" date, and applies to your use of the app from the date it is posted. If you do not agree to a revision, stop using the app.
12. Governing law
These Terms are governed by the laws of India, without regard to its conflict-of-law rules, and the courts of India will have jurisdiction over any dispute, except where the mandatory consumer protection law of your country of residence grants you the right to bring proceedings, or requires the application of its law, in which case that law and those rights apply.
